A Solicitor since 1983, a Licensed Insolvency Practitioner since 1989, a Mediator since 1996 and a Solicitor Advocate since 2007, Derek is a Fellow of the Association of Business Recovery Professionals.
He is a member of the Insolvency Lawyers’ Association, The Law Society’s Dispute Resolution Section, The Institute of Credit Management, a specialist member of The Institute of Risk Management, a member of the Commonwealth Lawyers’ Association and the holder of higher rights of audience in the civil courts of England and Wales.
One of less than 100 worldwide Derek is also an International Bar Association Fellow in International Legal Practice ( http://www.ibanet.org ).
In order to achieve this designation, the entry requirements for which were the successful completion of five International Practice Diploma modules over seven years, Derek completed six modules in two years covering subjects as diverse as arbitration law, business organisations, commercial law, human rights and criminal procedure, human rights law and practice and intellectual property.
Those modules were sponsored by some of the leading European and American law practices namely Debevoise and Plimpton LLP (New York, Washington, London, Paris, Frankfurt, Moscow, Hong Kong and Shanghais), Kurk Patrick and Lockhart Nicholson Graham LLP (Delaware, Boston, Dallas, Harrisburg, Los Angeles, Miami, Newark, New York, Palo Alto, Pittsburgh, San Francisco and Washington), JAUSAS (Barcelona and Madrid), The Human Rights Institute (established by the IBA in 1995 under the honourary presidency of Nelson Mandela) and DLA Piper Rudlick Gray Cary LLP (Asia, Europe and the US).
Derek’s experience includes successfully defending proceedings brought against an English client by a Russian distributor in the Moscow Courts, the proceedings being struck out as a result of our application based on the existence of an international arbitration clause in the contract.
The Russian company appealed the decision to the Moscow Court of Appeal and lost. The dispute is currently the subject of ongoing arbitration proceedings in England.
